Terms of Service

1. Who we are

Surgedeck ("we", "us") provides software that helps affiliate marketers generate landing pages and follow-up email copy. By creating an account you agree to these terms.

2. Your account

You must be at least 18 years old. You are responsible for your account credentials and for everything published under your account. One person or business per account.

3. What the service is and isn't

We give you drafting tools and hosting for your funnel pages. We do not write, review, or endorse the offers you promote, and we do not guarantee traffic, conversions, or income.

4. Content policy

You may not use Surgedeck to promote, host, or send traffic to any of the following:

• Income claims, guaranteed returns, or "get rich quick" promises of any kind.
• Financial, investment, crypto, forex, or trading advice presented as advice, and any offer promising specific financial results.
• Health, medical, supplement, or weight-loss claims that state or imply a cure, diagnosis, or treatment outcome.
• Adult content, gambling, firearms, illegal drugs, tobacco, or vaping products.
• Multi-level marketing recruitment, pyramid or matrix schemes, cash-gifting, or "business opportunity" offers built on recruitment.
• Deceptive practices: fake testimonials, invented names or photos, fabricated scarcity or countdowns, forced continuity, hidden billing terms, or impersonating a brand or person.
• Malware, phishing, cloaking, scraped or plagiarised content, or anything that infringes someone else's copyright or trademark.
• Harassment, hate speech, content targeting minors, or anything unlawful in your jurisdiction or ours.
• Collecting email addresses without honest disclosure of what you will send.

You must also comply with the CAN-SPAM Act, GDPR and UK GDPR where applicable, the FTC endorsement and affiliate disclosure guidelines, and the terms of your email provider and affiliate network.

5. Enforcement

We may take an individual funnel offline, suspend generation, or close an account that breaches this policy. Where we take a single funnel offline, your account, leads, and copy remain intact and available to you. We may act without notice where there is legal risk or risk to other customers.

6. Fair use of generation

Generation runs on our own AI credits and is subject to per-account and platform-wide limits shown in your dashboard. Automated or abusive use, resale of generation capacity, or attempts to bypass limits are prohibited.

7. Payment and refunds

Paid plans are billed in advance. Refunds are available within 30 days of purchase. Refunds may be declined where the service has been used abusively or in breach of the content policy.

8. Your content and ours

You keep ownership of the copy, brand, and lists you create or upload. You grant us the licence needed to host and display your funnel pages. We keep ownership of the software, templates, and training material.

9. Third-party services

The service integrates with third parties such as your email provider and affiliate networks. Their availability and terms are outside our control.

10. Disclaimers and liability

The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, our total liability is limited to the amount you paid us in the twelve months before the claim. We are not liable for lost profits, lost traffic spend, or lost commissions.

11. Changes

We may update these terms. Material changes will be announced in the app. Continued use after a change means you accept the updated terms.
